TERMS AND CONDITIONS
1. INTRODUCTION
1. These Terms and Conditions (“Terms”), form a legally binding agreement between:
• "The Provider": Deed Poll Agency UK, a UK-based service that prepares unenrolled legal name change documents (Deed Polls) for customers.
• "The Customer": The individual who submits an online Deed Poll application.
2. By submitting a Deed Poll application, you agree to all the terms outlined below. Please read them carefully before proceeding.
3. By submitting a Deed Poll application, you are consenting to receiving this digital product immediately and acknowledge that you will lose your right to cancel or a refund under the Consumer Contracts Regulations 2013.
2. CUSTOMER RESPONSIBILITIES
You (the Customer) agree to: 2.1 All customers:
1. Be at least 16 years of age to complete a Deed Poll application.
2. Not attempt to change your name to anything that:
• Infringes trademarks or copyrights.
• Is offensive, vulgar, or blasphemous.
• Promotes criminal or illegal activity.
• Incites hatred or discrimination.
• References controlled substances.
• Is intended to mislead others about your status (e.g. titles like "Sir", "Doctor", "Lord").
3. Provide accurate and complete personal details on the Deed Poll application.
4. Provide correct spelling, capitalisation, and punctuation (e.g. McBride-Sullivan), on the Deed Poll application.
5. Provide the correct UK phone format (+44, omitting the leading 0).
6. Provide a current address used on your official records (e.g. GP or driving licence).
7. Provide an email address that only you have access to in order for us to be able to email you your Deed Poll and any additional associated documentation.
8. Provide a mobile telephone number that only you have access to in order for us to be able to send you a text message (SMS) containing the password you require to access your Deed Poll and any additional associated documentation that we email you.
9. Check your Deed Poll application thoroughly before submission, correcting any mistakes and making sure the information you provide is correct, spelt correctly and uses the correct punctuation. By submitting a deed poll application, you are confirming that you wish for the information you have provided to be drafted on to your Deed Poll and any additional documentation, and exactly as you have provided them. Once submitted, changes, refunds or replacements may not be possible.
10. Select the Deed Poll you require before submitting your Deed Poll application such as, a Basic, Standard or Premium Deed Poll, as upgrades/downgrades are not permitted post-submission.
11. Pay using a debit/credit card in your name.
12. Check your spam and junk folder one (1) hour after submitting your Deed Poll application if you have not receive an email from us titled: “Your Deed Poll Has Arrived” or “Your Child’s Deed Poll Has Arrived,” if you have applied for a child Deed Poll.
13. Read the Deed Poll Handbook document attached to the email sent to you by us upon receipt and before signing and witnessing your Deed Polls to ensure you understand how to correctly execute your Deed Poll.
14. Check the correctness of the information drafted on to your Deed Poll and any accompanying documentation. If your Deed Poll or any accompanying documentation is incorrect and contains errors, because you have submitted incorrect information, we will not correct and reissue documentation unless you have selected the Premium Deed Poll option. Basic and Standard Deed Poll customers will unfortunately be required to submit another Deed Poll application, making sure they enter the correct information. In accordance with the Consumer Contracts Regulations 2013 regarding Digital Products, refunds will not be issued.
15. Print your Deed Poll and accompanying documentation. 16. Print multiple copies of your Deed Poll in order to inform as many record holders at once and as possible (we recommend at least 10).
17. Sign each printed Deed Poll copy in black ink using both your current and new signatures and in the presence of a witness. If your current signature does not identify your current name, you may sign your Deed Polls with the same signature for both your current and new name. If your current signature identifies your current name, you will need to sign your new name with a new signature.
18. Have each printed Deed Poll witnessed by the same eligible witness who is:
• 18 years of age or over.
• not related to you or not your partner.
• not living at the same address as you.
• aware of what they’re signing.
Your witness must sign each printed Deed Poll and write their full name and full address in black ink and on the same date as you entered your signatures.
19. Notify record holders (banks, employers, GP, DVLA, Passport Office, etc.) by sending or showing them an original, not photocopied, signed and witnessed Deed Poll, in accordance with their name change policies.
20. Not notify government agency record holders such as, the Driving Vehicle Licencing Agency (DVLA) or His Majesty’s Passport Office until you have notified private organisational record holders, in order to obtain a written document such as, a bank statement or utility bill in your new name, as government agencies will require these documents as proof that you are using your new name.
21. Paying any fees required to change your name with your private or government record holders such as but not limited to, obtaining a driving licence or passport in your new name.
22. Keep at least one signed and witnessed copy safe for future proof.
23. If you need support, contact us via email at helpdesk@deedpollagency.co.uk within thirty (30) days of submitting your Deed Poll application. After this period, your data will be securely deleted, and we will therefore be unable to provide you with support referring to your application.
24. Do not use your Deed Poll for fraudulent or illegal purposes.
25. Do not leave negative reviews or public complaints without first contacting us directly via email at helpdesk@deedpollagency.co.uk, Moreso if:
• Errors were due to incorrect customer-submitted information.
• Delays were due to external factors (spam filters, incorrect contact details).
• Errors out of our control.
2.2. Additional Terms & Conditions for Child Deed Poll Applications:
1. You must have legal parental responsibility for the child named in the Deed Poll application. By submitting the application, you confirm that you have the legal authority to change the child's name.
2. Where multiple individuals have parental responsibility, by submitting the application you confirm that:
• All parties with legal parental responsibility have given their full, informed consent to the name change.
• You understand that failure to obtain such consent may result in the Deed Poll being rejected by government bodies or record holders.
3. If you have sole parental responsibility, you may be required to provide documentary proof upon request (e.g. a court order, birth certificate without a second person named, or other legal documentation confirming sole responsibility).
4. You confirm that the name change is being made in the best interests of the child and not for fraudulent, misleading, or malicious purposes.
5. You agree that the child’s new name must comply with UK Deed Poll standards and may not:
• Infringe on trademarks or copyrights.
• Be offensive, obscene, or inappropriate.
• Promote illegal activity or incite discrimination.
• Include misleading titles or impersonations (e.g. "Prince", "Doctor", "Lord").
6. You understand that the child must be under the age of 16 to qualify for a child deed poll application. For individuals aged 16 and over, an adult Deed Poll application must be submitted instead.
7. You are responsible for checking the spelling, punctuation, and formatting of the child’s name and other details in the application. Mistakes due to incorrect information submitted will not be corrected unless you have selected the Premium option.
8. You must print, sign, and have the child’s Deed Poll correctly witnessed, in accordance with the instructions provided in the Deed Poll Handbook. You acknowledge that incorrectly executed Deed Polls may be rejected by official institutions.
9. Where appropriate, you agree to act on behalf of the child in notifying relevant organisations (e.g. passport office, schools, healthcare providers) of the name change using the signed and witnessed Deed Poll.
10. You acknowledge that some institutions may request additional proof of parental responsibility or consent from all parties with parental responsibility before accepting the child’s name change.
11. You will not hold the service provider liable for any rejection of the child’s Deed Poll by third-party organisations, where such rejection results from:
• A lack of valid consent from all parties with parental responsibility.
• Errors in submitted information. • Improper execution or presentation of the Deed Poll.
• The internal policy of that organisation.
2.3 Additional Terms & Conditions for Replacement (Retrospective) Deed Poll Applications:
1. A Replacement (“Retrospective”) Deed Poll is a newly drafted Deed Poll intended solely to confirm and legally evidence a previous name change that has already occurred and been in consistent use. It is not a replica or copy of your original change of name document.
2. By submitting a Replacement Deed Poll application, you confirm that:
• You previously changed your name and have been consistently using your new name in good faith.
• You now require a replacement or retroactive document to support or prove that previous change.
3. You understand that a Replacement Deed Poll does not backdate legal effect in law but serves as a formal declaration that the name change took place on a previous date and has been in use since that time.
4. You must provide the correct and verifiable previous name and current name, as well as the original date from which the new name has been in consistent use.
5. If false or misleading information is provided regarding the date or nature of the name change, the Deed Poll may be deemed invalid by record holders or government agencies.
6. A Replacement Deed Poll may not be accepted by some organisations if you cannot demonstrate continuous usage of the new name or if further evidence (such as original name change records, historical ID, or other proof) is requested and not provided.
7. You confirm that the replacement (retrospective) Deed Poll is not being used to falsify, mislead, or create a new legal identity, but to reflect a genuine, existing name change for which prior documentation has been lost, misplaced, or was never formally recorded.
8. Where applying for a Replacement Deed Poll on behalf of a child, you must also adhere to all terms listed under Section 2.2: Child Deed Poll Applications.
9. You understand that:
• This service provides a formal Deed Poll document based on the information you supply.
• It is your responsibility to ensure that the details, especially dates and spelling, are correct at the time of submission.
10. You will not hold the service provider liable for:
• Rejection of your Replacement Deed Poll by third-party organisations.
• A lack of acceptance due to insufficient supplementary evidence (e.g. usage history, ID updates, etc.).
• Errors caused by incorrect information submitted in your application.
3. PROVIDER RESPONSIBILITIES
We (the Provider) agree to:
1. Draft and generate your Deed Poll and accompanying documentation with our automated software instantly and automatically when you submit your Deed Poll application, based solely on the information you submitted and how you submitted it which includes but is not limited to, the spelling and punctuation you use or do not use.
2. Deliver your Deed Poll and any accompanying documentation via email in a password-protected PDF format to the email address you submitted on your Deed Poll Application.
3. Deliver, via SMS (text message), a password to access your password protected PDF Deed Poll and accompanying documentation to the mobile telephone number you submitted on your Deed Poll Application.
4. For Premium Deed Poll holders, we will also provide a lifetime (100-year) verification service, verifying to your record holders, if requested by your record holders, that the Deed Poll displaying the Deed Poll Document Number stated or entered by them that, the Deed Poll is issued by us and once signed and witnessed, is a legally binding document and evidence of legal name change. We do not divulge your personal information.
5. For Premium Package holders, we will also provide a thirty (30) day corrections and replacement service meaning, should you receive your Deed Poll and identify a mistake in the information you have submitted, we will correct the mistake and re-email you with your corrected documents as long, you inform us within thirty (30) days of your application submission date and time, by email to: helpdesk@deedpollagency.co.uk and stating that you need your documents correcting and reissuing. We aim to respond to emails within two (2) working days (Monday to Friday) and once we confirm we have received your email, we will email your corrected documents to the original email address you provided on your Deed Poll application within five (5) working days.
6. Keep your data safe and secure and not share your personal data with any third parties unless: • Required to by law. • You dispute the payment for our services to your card provider, in which case, we are required to provide the financial investigation department with evidence to prove that you knowingly and consensually made the said purchase. • You report us to an independent commission, in which case, we are required to provide information on your application and any communication you have with us. • You take legal action against us, in which case, we are required to provide information on your application and any communication you have with us.
7. After the thirty (30) day point of your application submission date and time, securely delete your data, as we consider our business to be concluded, and we are no longer required to hold it.
8. Not send you spam emails.
9. Not send you spam text messages (SMS)
10. Never call you unless you give us explicit permission in writing to do so.
4. PROVIDER LIMITATIONS
We are not responsible for:
1. Email delivery delays due to incorrectly submitted email addresses.
2. Text message (SMS) deliver delays due to incorrectly submitted mobile telephone numbers.
3. Emails from us which are routed to your spam or junk folder, it is your responsibility to check said folders one (1) hours after submitting your application.
4. Any additional technical issues beyond our control.
5. Rejection of documents by record holders due to you submitting errors on your application, executing your Deed Poll incorrectly and not in accordance with our Deed Poll Handbook or UK law, or not following the correct process when notifying your record holders.
6. Any indirect or consequential loss caused by use or non-use of the documents provided by us.
7. Paying any fees to private or government record holders for them to update their records or provide new documents such as but not limited to, driving licences or passports with your new name.
5. REFUND POLICY
1. As your Deed Poll and any accompanying documentation is instantly and automatically generated and delivered via email by our software upon submission, your application, once submitted cannot be cancelled and no refunds will be issued, in accordance with Consumer Contracts Regulations 2013.
2. By submitting a Deed Poll application with us, you have acknowledged that you will lose your right to cancel or a refund under the Consumer Contracts Regulations 2013.
6. REPLACEMENT POLICY
6.1. Customer Errors:
1. If you have made a mistake, only customers who purchased a Premium Deed Poll may request application corrections and the re-issuing, via email, of the corrected Deed Poll documents and any accompanying documentation (for pre-execution errors only) by emailing us at helpdesk@deedpollagency.co.uk within thirty (30) days of submitting your Deed Poll application. After thirty (30) days, this service will not be available. Documents will be corrected and reissued to the email address stated on your original Deed Poll application within 5 working days (Monday to Friday) of us confirming, via email to you, that we will make the required corrections. Customers who purchased Basic or Standard Deed Polls will not be entitled to application corrections and/or the re-issuing of documents.
6.2. Provider Errors:
1 If we have made a mistake, we will make any corrections required and re-issue your documents via email, to the email address you entered on to your original Deed Poll application however, you must inform us of any mistakes by emailing us at helpdesk@deedpollagency.co.uk within thirty (30) days of application submission and time. After thirty (30) days, this service will not be available as we will no longer hold your data. Documents will be corrected and reissued to the email address stated on your original Deed Poll application within 5 working days (Monday to Friday) of us confirming, via email to you, that we will make the required corrections
6.3 YOU MUST REPORT ERRORS WITHIN 30 DAYS OF SUBMITTING YOUR APPLICATION. AFTER SUCH POINT, WE WILL NO LONGER HOLD YOUR DATA.
7. PRIVACY AND DATA PROTECTION
1. We comply with UK GDPR and the Data Protection Act 2018 and as such, your data is used solely to process your Deed Poll, any accompanying documentation, and support related services.
2. We store your data securely for thirty (30) days after you submit your Deed Poll application, then securely delete it permanently within thirty (30) days after the thirty (30) days post your application submission date and time.
3. We automatically delete your data thirty (30) days after you submit your Deed Poll application however, you may request deletion of your data before the thirty (30) days are up, by emailing helpdesk@deedpollagency.co.uk.
4. We never share any of your information unless:
• Required to by law.
• You dispute the payment for our services to your card provider, in which case, we are required to provide the financial investigation department with evidence to prove that you knowingly and consensually made the said purchase. • You report us to an independent commission, in which case, we are required to provide information on your application and any communication you have with us.
• You take legal action against us, in which case, we are required to provide information on your application and any communication you have with us.
5. We will never send you spam emails.
6. We will never send you spam text messages (SMS).
7. Never call you unless you give us explicit permission in writing to do so. 8. Your documents are protected with industry-standard security.
8. TERMINATION
1. We reserve the right to refuse service if you breach these terms.
2. Your application cannot be cancelled by you once you submit it, in accordance with the regulations for digital products under the Consumer Contracts Regulations 2013.
9. GOVERNING LAW AND DISPUTES
1. These Terms are governed by the laws of England and Wales.
2. Disputes must first be attempted to be resolved via mediation.
3. Legal claims will fall under the jurisdiction of the courts of England and Wales.
10. CONTACTING US
1. If you need to contact us for any reason, you must do so via email within 30 days of the date and time you submitted your Deed Poll application. After 30 days, your submission will be securely removed and your data deleted and as such, we will not have the data available to provide support.
2. Our email address is: Helpdesk@deedpollagency.co.uk and we aim to reply to all emails within two (2) working days (Monday to Friday) of receiving it.
11. ENTIRE AGREEMENT
1. These Terms and Conditions represent the complete agreement between you and us. We may update them at any time. Updates will be posted on our website and take effect immediately.
2. By submitting a Deed Poll application with us, you confirm that you have read, understood, and agreed to these Terms and Conditions.
